Audio from Erik Menendez’s Parole Hearing Sparks Family Uproar After Both Brothers Denied Release

Erik Menendez has been denied parole for another three years following a nearly 12-hour hearing—just one day after his brother Lyle received the same outcome. Both were convicted in 1996 for the fatal shootings of their parents in Beverly Hills and had been deemed eligible for parole this year after resentencing under youth offender provisions.

During Erik’s hearing, which concluded on August 21, audio of his testimony was publicly released via a records request. The clip triggered emotional reactions in the courtroom. Family members reacted strongly—Tiffani Lucero Pastor called it “disgusting.”

In the recording, Erik described being driven by fear and rage the night of the killings. “Dad was going to come to my room and rape me that night… and so I just ran and got the gun,” he said. He added that he viewed his mother as a victim too, saying, “She was his victim… I saw them as one person.” He also lamented the moral confusion he felt, saying he was raised to lie and cheat, lacking a sense of right and wrong.

Parole officials recognized Erik’s display of remorse and his behavior as a model inmate. However, they cited his history of rule violations, deception, and possession of contraband cell phones as indicators he might still pose a risk to public safety. Despite his regret and personal reflections, the board concluded that releasing him would be “too big a risk.”
